Terms and Conditions – GPS Gas and Plumbing Services
All works carried out by GPS Gas and Plumbing Services (quoted or otherwise) are subject to these Terms and Conditions. It is the client’s sole responsibility to carefully read and understand these Terms and Conditions before engaging our services. Legal advice should be sought if required.
Definitions
“GPS” means GPS Gas and Plumbing Services, including agents, contractors, and employees.
“Client” means the individual, company, or entity purchasing services from GPS, including any authorised person acting on their behalf.
Payments
- Clients agree to make progress payments as requested. Failure to make timely payments may result in the suspension of works.
- Full payment must be made upon completion of works unless otherwise agreed in writing.
- Payment methods accepted: Credit card, bank transfer, and cash.
- Clients authorise GPS to process transactions over the phone where necessary, including deposits, progress, or final payments.
- All quoted works are subject to variations as deemed necessary to meet Australian Standards and Workplace Safety Standards. Variations will incur additional charges.
- GPS reserves the right to adjust charges without notice.
- After-hours services will incur additional charges.
Cancellation Policy
- GPS reserves the right to cancel any service with at least 24 hours’ written notice.
- Clients must provide at least 2 working days’ written notice for cancellations. Failure to do so may result in charges.
- Deposits paid are non-refundable.
Warranty
- Workmanship is warranted indefinitely unless otherwise stated on the invoice.
- Warranty applies only to the location and work performed by GPS, and proof of original invoice is required.
- Outsourced materials are subject to manufacturer warranties only.
- All valve-related parts must be serviced annually by GPS to maintain warranty validity.
- Clients must report any defects within 48 hours of job completion, in writing.
- GPS must be allowed to inspect and rectify any defects within 7–14 working days.
- Blocked drains, sewer lines, and stormwater drains carry no warranty on future blockages, regardless of the recurrence timeline.
Intellectual Property
Any designs, drawings, or plans created by GPS remain the intellectual property of GPS Gas and Plumbing Services and cannot be used without written consent.
Client Disclaimer
The Client acknowledges that services are purchased based on their judgment and that GPS is not responsible for any misrepresentation by employees or agents beyond the manufacturer’s warranty terms.
Warranties are not transferable to new property owners.
Underground Services
- The Client indemnifies GPS against all liability for disturbance or damage to underground services.
- Repair costs arising from the disturbance of unseen services are payable by the Client.
- Damages include but are not limited to property damage, injury, or consequential loss.
Rock and Filled Ground
Unless specifically stated, quotations assume clean soil excavation only.
Additional charges apply for:
- Rock excavation
- Dewatering
- Structural supports (e.g., piers, beams)
- Concrete, paving, landscaping restoration, and shrub/lawn replacement are treated as variations and will incur additional charges.
Drains and Sewers
- Blocked pipes generally indicate pipe damage and cannot be permanently fixed by root removal or cleaning.
- GPS provides no warranty for the future re-blockage of drains or sewer lines.
- Use of CCTV equipment is at GPS’s discretion and will incur additional charges.
- If GPS equipment becomes lodged in the client’s drainage system, retrieval or replacement costs are the client’s responsibility.
- Landscaping services post-repair are not included unless specified.
Dispute Resolution
- Disputes must be notified in writing within 7 days of arising.
- Parties will meet within 7 days of notification to attempt a resolution.
- If unresolved, disputes may be referred to arbitration through the Consumer Trader & Tenancy Tribunal (CTTT).
Compliance with Laws
- Both parties must comply with all relevant government regulations, standards, and laws.
- The Client is responsible for obtaining all necessary permits, licenses, and council approvals before commencement of work.
- Clients must ensure work sites meet Occupational Health and Safety (OHS) requirements.
General
- GPS may use client information for future marketing unless advised otherwise.
- GPS is not liable for work delays caused by weather, strikes, shortages of materials, or other circumstances beyond our control.
- Property damage during works is not GPS’s responsibility unless due to proven negligence.
- In the event of a breach, GPS’s liability is limited to the value of the goods and services provided.
- Terms and Conditions are subject to change without notice.
Charges
- No Call-Out Fee: GPS does not charge call-out or site attendance fees for quotes.
- Deposit Requirement: For jobs exceeding $2,000 (incl. GST), a 10% deposit is required 24 working hours before the commencement of works.
- Emergency Response Fee: If emergency service is requested and a technician arrives within 60 minutes, an additional emergency response fee will be charged at GPS’s discretion.
